LEGAL NOTICE FOR ANNUAL AND SPECIAL ELECTION

PLEASE TAKE NOTICE that the Annual and a Special Election of the Tallman Fire District will be held on December 12, 2006 at the Firehouse on Route 59, Tallman, New York, for the following purposes:

(1)  The officers to be elected at said annual election, with their respective terms of office are:

OFFICER                                              TERM OF OFFICE

Fire District Commissioner                    Five year term

                                                   (until December 31, 2011)

All candidates for office must file their names with the Secretary of the Fire District not later than November 22, 2006.                                    

The polls for said election will be open for receipt of ballots at 6:00 p.m. (EST) and shall be closed at 9:00 p.m. (EST) in the evening to vote.

All duly registered residents of the Tallman Fire District shall be eligible to vote; and

(2) The adoption or rejection of the resolution of the Board of Fire Commissioners authorizing amendment of the Service Award Program.

EXTRACT OF RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE TALLMAN FIRE DISTRICT AMENDING THE SERVICE AWARD PROGRAM.

WHEREAS, voters of the Tallman Fire District approved a referendum to establish a Service Award Program for the Tallman Fire District effective January 1, 1990, in accordance with Article 11-A of the New York State General Municipal Law; and

WHEREAS, Article 11-A authorized the Tallman Fire District Board of Fire Commissioners to seek voter approval of amendments to the Service Award Program; and

WHEREAS, many of these amendments are intended to enable the Board of Fire Commissioners to improve the Service Award Program benefits to active volunteer firefighters of the Fire District; and

WHEREAS, such improvement to the Service Award Program benefits is consistent with the intent of the program to help the Fire District recruit and retain active volunteer firefighters;

NOW THEREFORE, BE IT RESOLVED, that

The Board of Fire Commissioners of the Tallman Fire District, as authorized by Article 11-A of the New York State General Municipal Law, directs that there shall be a public referendum of eligible voters of the Tallman Fire District in an election to be held on December 12, 2006, to determine whether Tallman Fire District Defined Benefit Service Award Program shall be amended effective January 1, 2007 to credit years of service for members who reached the entitlement age, and are receiving a service award benefit. 

All other provisions of the Tallman Fire District Service Award Program which required voter approval shall not change.  The program shall continue to be administered by the Tallman Fire District Board of Fire Commissioners in accordance with Article 11-A of the New York State General Municipal Law as such law is amended from time to time.

The polls will be kept open for the purposes of voting during the aforesaid hours and the proposition will be in substantially the following form, to wit:

Shall the Board Resolution of the Tallman Fire District, Town of Ramapo, County of Rockland, State of New York, entitled:

 

“BOARD RESOLUTION OF THE TALLMAN FIRE DISTRICT IN THE TOWN OF RAMAPO, COUNTY OF ROCKLAND, STATE OF NEW YORK, ADOPTED AUGUST 15, 2006, AUTHORIZING AMENDMENT OF THAT CERTAIN BOARD RESOLUTION OF THE TALLMAN FIRE DISTRICT IN THE TOWN OF RAMAPO, COUNTY OF ROCKLAND, STATE OF NEW YORK, WHICH WAS ADOPTED AND PASSED BY SPECIAL ELECTION REFERENDUM DECEMBER 19, 1989, AND WHICH ESTABLISHED A DEFINED BENEFIT SERVICE AWARD PROGRAM FOR THE VOLUNTEER FIREFIGHTERS OF THE TALLMAN FIRE DISTRICT BY ADDING A ONE TIME LUMP SUM PAYMENT IN THE AMOUNT OF $41,553.27 TO COMPENSATE CERTAIN MEMBERS OF THE PROGRAM WHO REACHED ENTITLEMENT AGE BUT DID NOT RECEIVE CREDIT OR BENEFITS FOR A PERIOD OF TIME IN WHICH THEY PERFORMED SERVICES FOR WHICH THEY WERE ABLE TO RECEIVE BENEFITS, be approved?
